Welcome to HotDate (the "Application" or "Service")!
These Terms of Service ("Agreement") are entered into between the HotDate Team ("Company," "we," or "us") and users of HotDate and its related services ("you" or "User"). This Agreement governs your use of HotDate for communicating with other Users and accessing other online services provided by us. By clicking the "Register" button on the registration form, you acknowledge and accept all terms and conditions of this Agreement and consent to your registration as a HotDate User.
If you do not agree to any provision of this Agreement, please refrain from clicking the "Register" button. Clicking the "Register" button binds you to these terms, regardless of whether you complete the registration process or purchase any paid services. We reserve the right to modify this Agreement at any time. Modified versions will take effect immediately upon publication on our website or Application, and such publication shall constitute sufficient notice to you.
By accessing or using HotDate, you confirm that you have read, understood, and agreed to be bound by this Agreement and any supplementary policies (including but not limited to the Privacy Policy) referenced herein.
HotDate may update or revise this Agreement from time to time. Continued use of the Service after the publication of updated terms constitutes your acceptance of the modified Agreement. If you disagree with the changes, you must cease using HotDate immediately.
By registering for or using HotDate, you represent and warrant the following:
a. You are 18 years of age or older;
b. You are not prohibited from using the Service under the laws of the United States or any other applicable jurisdiction;
c. You will comply with this Agreement and all applicable local, state, national, and international laws, rules, and regulations;
d. You have never been convicted of a felony, indictable offense, sex crime, or any crime involving violence, and you are not required to register as a sex offender.
You may create an account through manual registration or by using Google, Facebook, or Apple ID login credentials ("Third-Party Account"). Using a Third-Party Account authorizes us to access, display, and use certain information from that account, as detailed in our Privacy Policy.
All registration information must be accurate, complete, and truthful. Inaccurate or incomplete information may result in account suspension until verification is completed.
You are solely responsible for maintaining the confidentiality of your account password and all activities conducted under your account. Transactions performed using valid login credentials are deemed authorized by you.
You may not authorize others to use your account, transfer your account to a third party, or share your account access with others.
We may suspend or terminate your account if: (i) our Support team reviews correspondence and determines you have lost interest in the Service; (ii) you request the deletion of your personal data without providing a specific reason; (iii) you are identified on anti-fraud platforms or there is credible evidence of your involvement in illegal activities.
HotDate strictly prohibits individuals under the age of 18 (the "Minimum Age") from registering for, accessing, or using any part of the Service. This prohibition applies notwithstanding any local jurisdiction laws, unless such laws mandate a higher minimum age, in which case the higher age shall govern.
By registering for or using the Service, you affirm and warrant that you are at least 18 years of age (or the applicable higher minimum age) and have provided accurate age information during registration.
If you are a parent or legal guardian and become aware that your minor child has registered for or used the Service without authorization, you must immediately notify HotDate at albanjonit926@gmail.com and request account termination.
HotDate reserves the right to verify the age of any User at any time. If we determine (in our sole discretion) that a User is under the Minimum Age, we will immediately terminate the User’s account, delete all associated personal data (to the extent required by law), and may take additional legal action as necessary.
HotDate has zero tolerance for any activity that endangers minors, including but not limited to enticement, exploitation, abuse, assault, coercion, promotion of self-harm, suicide-related content, or threats targeting minors. Any User found engaging in such activities will have their account permanently terminated, and we will report the conduct to relevant law enforcement authorities.
If you encounter a User you believe to be under the Minimum Age or observe any activity endangering minors, please report it immediately via the in-app reporting mechanism or by emailing albanjonit926@gmail.com, providing relevant details (e.g., username, content screenshots, conversation logs) to assist in our investigation.
HotDate is intended for personal, non-commercial use exclusively. Organizations, companies, and businesses are prohibited from becoming Users or using the Service. Illegal or unauthorized use—including collecting User information for unsolicited emails, unauthorized linking to the Service, creating competitive databases/websites/applications/software/services, money transmission, or using false identities—is strictly prohibited and may result in legal action.
Subject to your compliance with this Agreement, HotDate grants you a personal, limited, non-commercial, non-exclusive, non-sublicensable, non-transferable, and revocable license to access and use the Service on a personal device for personal purposes only. If you access the Service via a third-party platform, you are also subject to that platform’s terms of service.
You may not: (i) copy, modify, distribute, sell, lease, reverse engineer, or extract the source code of the Service without prior written permission or legal authorization; (ii) circumvent any technological measures implemented to protect the Service; (iii) engage in automated data collection or create fake accounts.
All content, information, photos, videos, calls, or personal data ("Content") you post, transmit, or share through HotDate is subject to our periodically updated content guidelines.
You are solely responsible for all Content you post or transmit via the Service.
By posting Content, you grant HotDate an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, reproduce, perform, display, distribute, and create derivative works of such Content.
Prohibited
Content includes, but is not limited to:
(a) Racism, bigotry,
hatred, or promotion of physical harm;
(b) Harassment,
bullying, or intimidation;
(c) Spam, chain letters, or
unsolicited mass mailings;
(d) Defamatory, false, misleading,
or fraudulent content, or promotion of illegal activities;
(e)
Unauthorized copying or distribution of copyrighted works;
(f)
Restricted or hidden pages/images;
(g) Inappropriate content
(including nudity, bestiality, pornography, excessive violence, or
depictions of criminal activity);
(h) Exploitation of minors or
solicitation of their personal information;
(i) Instructions
for committing illegal acts;
(j) Soliciting passwords or
personal information for commercial or illegal purposes;
(k)
Commercial activities or advertising without HotDate’s prior
written consent.
Your profile may not contain phone numbers, physical addresses, real names, URLs, or email addresses. Communications with other Users may not include URLs, email addresses, or phone/fax numbers.
Advertising, soliciting, chain letters, or spam is prohibited. Using User information to harass, abuse, harm, or contact others without their consent is strictly forbidden. We reserve the right to limit the number of emails or messages you send through the Service.
Communications may be recorded for quality assurance purposes.
HotDate may review, remove, or restrict access to any Content at its discretion if it violates this Agreement, is offensive, illegal, or infringes on the rights or safety of others. We may investigate violations and take legal action as necessary.
HotDate owns or retains all intellectual property rights in the Application, Service, and related materials, including but not limited to copyrights, patents, trademarks, trade secrets, and other proprietary rights.
You may not copy, modify, publish, transmit, distribute, perform, display, sell, or exploit any proprietary information of HotDate without our prior written permission, unless such information is in the public domain. Commercial use, reproduction, or licensing of HotDate’s intellectual property to third parties requires formal written authorization from us.
You may not post, upload, or share any copyrighted material through the Service without obtaining prior permission from the copyright owner. If you believe that your copyrighted work has been infringed upon through the Service, please provide HotDate’s Copyright Agent with the following information:
A signature of the authorized representative of the copyright owner;
A detailed description of the copyrighted work;
The location (e.g., URL, username) of the allegedly infringing material on the Service;
Your contact information (name, address, phone number, and email address);
A statement of good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
A statement, made under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.
You are solely responsible for all interactions with other HotDate Users, including but not limited to meetings, communications, or transactions. HotDate may monitor disputes between Users at its discretion but has no obligation to do so. We are not responsible for the authenticity of User information, promises made by other Users, or any expectations you may have regarding interactions with other Users.
The Service may integrate or link to third-party services (e.g., payment processors, social media platforms). Your use of such third-party services is subject to their respective terms of service and privacy policies. HotDate does not guarantee the security, accuracy, reliability, or effectiveness of third-party services, and you assume all risks associated with using them. Disputes with third-party service providers are your sole responsibility.
HotDate may engage third-party and affiliated marketing partners ("Suppliers") to assist in providing the Service. Suppliers are independent contractors, and HotDate is not liable for their acts, omissions, or service quality. Supplier services may include:
Providing registration-related information;
Offering translation services and facilitating access to User communications;
Delivering additional services as agreed upon with HotDate;
Processing other supplementary services (which are not automatically granted to Users).
All services provided by Suppliers are offered "as is" without any warranties, express or implied.
Using the Service may require the collection, use, and storage of your personal data. HotDate’s Privacy Policy explains our data handling practices, including how we collect, use, protect, and disclose your information. The Privacy Policy is incorporated into this Agreement by reference, and using the Service constitutes your acceptance of the Privacy Policy.
HotDate provides the Service "as is" and "as available" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted/error-free operation.
We do not warrant that the Service will be secure, reliable, or free of defects, or that any defects will be corrected. HotDate is not responsible for: (i) service interruptions or unavailability due to technical issues, network congestion, or other factors beyond our control; (ii) offensive, illegal, or inappropriate content posted by Users; (iii) misuse of personal information by other Users; (iv) the accuracy or authenticity of User-generated content; (v) any damages or losses resulting from your use of the Service or interactions with other Users.
To the fullest extent permitted by applicable law, HotDate shall not be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages, including but not limited to lost profits, data loss, or service interruption, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising out of or related to this Agreement or the Service shall be limited to the total amount of fees you have paid to HotDate for the Service in the 12 months prior to the claim. HotDate is not responsible for any activities that occur outside the scope of the Service.
You agree to indemnify, defend, and hold harmless HotDate, its subsidiaries, affiliates, officers, directors, agents, partners, and employees from and against any and all third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:
Your use of the Service or any breach of this Agreement by you or others using your account;
Your violation of any applicable laws, regulations, or third-party rights (including intellectual property rights) in connection with the Service;
Claims that your Content infringes upon the intellectual property or other rights of a third party;
Any other act or omission by you in relation to the Service.
This indemnification obligation applies regardless of whether the claim arises from negligence on your part.
You may terminate your HotDate account at any time by sending a written notice to albanjonit926@gmail.com.
HotDate may terminate your account or suspend your access to the Service for any reason (with or without cause) by sending notice to your registered email address.
If we terminate your account without cause, you will receive a pro-rated refund of any unused paid service fees.
No refunds will be provided if your account is terminated due to a breach of this Agreement or at your own request.
Paid services are non-refundable unless explicitly stated otherwise in this Agreement.
This Agreement shall remain in effect after termination, including but not limited to provisions related to indemnification, intellectual property, disclaimer of warranties, and limitation of liability.
Headings : Clause titles are for reference only and do not affect the interpretation or enforceability of this Agreement.
Severability : If any provision of this Agreement is deemed invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
Language : In the event of any discrepancy between the English version of this Agreement and any translated versions, the English version shall prevail.
No Waiver : Our failure to enforce any provision of this Agreement shall not constitute a waiver of that provision or our right to enforce it in the future.
Entire Agreement : This Agreement constitutes the entire understanding between you and HotDate regarding the Service, superseding all prior or contemporaneous agreements, communications, and understandings (whether written or oral). Additional terms may apply to third-party content or services accessed through the Service.
